{"id":245467,"date":"2004-06-24T13:14:52","date_gmt":"2004-06-24T17:14:52","guid":{"rendered":"https:\/\/www.bahamasb2b.com\/news\/2004\/06\/ninety-release-ruling-from-supreme-court"},"modified":"2004-06-24T13:14:52","modified_gmt":"2004-06-24T17:14:52","slug":"ninety-release-ruling-from-supreme-court","status":"publish","type":"post","link":"https:\/\/www.bahamasb2b.com\/news\/2004\/06\/ninety-release-ruling-from-supreme-court","title":{"rendered":"Ninety&#8217; Release Ruling From Supreme Court"},"content":{"rendered":"<p>Lawyers from the Attorney General&#8217;s office, representing the US government, are now believed to be seeking a stay of the ruling, to prevent Knowles being freed from proson immediately.<br \/>\n<P><br \/>\nThe ruling, handed down by Justice Hugh Small, said there are &#8216;&#8221;substantial grounds for concluding&#8221; that Knowles might not be getting a fair trial in the US because President George Bush prejudiced his case by designating him a &#8220;foreign narcotics kingpin&#8221;.<br \/>\n<P><br \/>\nThe ruling comes as Director of Public Prosecutions Bernard Turner and lead prosecutor Francis Cumberbatch are in Washington, DC, where it was announced yesterday that a Bahamian drug trafficking gang had been smashed in a major multinational operation.<br \/>\n<P><br \/>\nKnowles&#8217; lawyer Edward Fitzgerald, QC, successfully argued under the Foreign Narcotics Kingpin Designation Act in May 2002, the president prejudiced Knowles&#8217; case, as judicial proceedings against him were already well underway.<br \/>\n<P><br \/>\nKnowles has been lumped together with such people as Saddam Hussein, Osama Bin Laden and Slobodan Milosevic, who are included on similar lists, Mr. Fitzgerald argued.<br \/>\n<P><br \/>\nKnowles was one of seven &#8220;kingpins&#8221; added to the list of around 40 in May 2002, making him the target of sanctions blocking him from any financial dealings with US companies or citizens.<P><br \/>\nThe Extrdaition Act states thata person shall not be extradited if they might as a result &#8220;be denied a fair trial or punished, detained or restricted in his personal liberty by reason of his race, religion, nationality or opinions&#8221;.<br \/>\n<P><br \/>\nIn this case Knowles was deemed to have been discriminated against on the basis of nationality, as only a non-US citizen can be a &#8220;foreign narcotics kingpin&#8221;.<br \/>\n<P><br \/>\nMr. Fitzgerald argued that if Knowles were sent to Florida to face charges there would be media reports of his designation as a kingpin, so it would be very difficult to find a jury that was not prejudiced.<br \/>\n<P><br \/>\nHe also argued that Knowles would not have &#8220;unimpeded access&#8221; to legal representation as anyone receiving money from him is required to obtain a licence from the Office of Foreign Assets Control.<br \/>\n<P><B>Source: Robert Bain, The Tribune<\/B><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court ruled yesterday that drug offender Samuel &#8216;Ninety&#8217; Knowles can no longer be detained pending extradition to the United States, and should be released.<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"rop_custom_images_group":[],"rop_custom_messages_group":[],"rop_publish_now":"initial","rop_publish_now_accounts":{"facebook_10223285771444175_51037792744":""},"rop_publish_now_history":[],"rop_publish_now_status":"pending","footnotes":""},"categories":[12],"tags":[],"class_list":["post-245467","post","type-post","status-publish","format-standard","hentry","category-headlines"],"_links":{"self":[{"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/posts\/245467","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/comments?post=245467"}],"version-history":[{"count":0,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/posts\/245467\/revisions"}],"wp:attachment":[{"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/media?parent=245467"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/categories?post=245467"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/tags?post=245467"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
