{"id":247234,"date":"2005-06-23T10:49:40","date_gmt":"2005-06-23T14:49:40","guid":{"rendered":"https:\/\/www.bahamasb2b.com\/news\/2005\/06\/isaacs-extradition-ruling-quashed"},"modified":"2005-06-23T10:49:40","modified_gmt":"2005-06-23T14:49:40","slug":"isaacs-extradition-ruling-quashed","status":"publish","type":"post","link":"https:\/\/www.bahamasb2b.com\/news\/2005\/06\/isaacs-extradition-ruling-quashed","title":{"rendered":"Isaacs&#39; Extradition Ruling Quashed"},"content":{"rendered":"<p>The Court of Appeal ruled yesterday that a Supreme Court judge erred when he determined several weeks ago that The Bahamas&#8217; extradition treaty with the United States was null and void.<\/p>\n<p>The ruling from the high court came as a major victory for the Attorney General&#8217;s Office, which had immediately appealed the decision of Justice Jon Isaacs, who had determined that the treaty was not properly laid before parliament back on April 13, 1994.<\/p>\n<p>&#8220;The terms of the Treaty, and in particular Article 18, did not receive the prior approval of Parliament,&#8221; Justice Isaacs&#8217; 57-page ruling says.<\/p>\n<p>The Court of Appeal, however, has not yet issued a written ruling and plans to outline the reasons for its determination at a later date.<\/p>\n<p>The treaty allows U.S. officials to seek the extradition of anyone in The Bahamas believed to be guilty of a crime in the U.S. or against the United States.<\/p>\n<p>It also allows Bahamian officials to seek the extradition of suspects residing in the United States.<\/p>\n<p>Justice Isaacs&#8217; decision had directly affected several men at Her Majesty&#8217;s Prison who were arrested last year as part of a major regional drug smuggling ring.<\/p>\n<p>They included Brian and Lynden Deal; Thomas Roberts, Devroy Moss, Sheldon Moore, Shanto Curry and Gordon Newbold.<\/p>\n<p>Attorneys for the men could not be reached yesterday evening for reaction to the ruling, but Godfrey &#8220;Pro&#8221; Pinder, who represented two of the suspects, said in an earlier interview with The Bahama Journal that Justice Isaacs&#8217; ruling had meant that the men were being held illegally at Her Majesty&#8217;s Prison.<\/p>\n<p>He had also indicated that the case would go all the way to the Privy Council if necessary.<\/p>\n<p>Prior to yesterday&#8217;s ruling, the Ministry of Foreign Affairs had delivered a formal Diplomatic Note to the U.S. government reaffirming this country&#8217;s commitment to the extradition treaty. <\/p>\n<p>It had also stressed that &#8220;the status quo, with regard to all persons in the extradition process in The Bahamas and the extradition treaty itself remains, until there is further order of the court.&#8221;<\/p>\n<p><small>From The Bahama Journal<\/small><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Court of Appeal, however, has not yet issued a written ruling and plans to outline the reasons for its determination at a later date.<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"rop_custom_images_group":[],"rop_custom_messages_group":[],"rop_publish_now":"initial","rop_publish_now_accounts":{"facebook_10223285771444175_51037792744":""},"rop_publish_now_history":[],"rop_publish_now_status":"pending","footnotes":""},"categories":[12],"tags":[],"class_list":["post-247234","post","type-post","status-publish","format-standard","hentry","category-headlines"],"_links":{"self":[{"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/posts\/247234","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/comments?post=247234"}],"version-history":[{"count":0,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/posts\/247234\/revisions"}],"wp:attachment":[{"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/media?parent=247234"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/categories?post=247234"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/tags?post=247234"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
