{"id":2534,"date":"2010-09-28T10:04:47","date_gmt":"2010-09-28T14:04:47","guid":{"rendered":"http:\/\/www.bahamasb2b.com\/news\/?p=2534"},"modified":"2015-07-31T18:58:54","modified_gmt":"2015-07-31T22:58:54","slug":"judge-defends-bahamianisation-of-judiciary","status":"publish","type":"post","link":"https:\/\/www.bahamasb2b.com\/news\/2010\/09\/judge-defends-bahamianisation-of-judiciary","title":{"rendered":"Judge Defends Bahamianisation Of Judiciary"},"content":{"rendered":"<p>Senior Supreme Court Justice Anita Allen has fired back at criticisms that the Bahamianisation of the judicial system has been a &#8220;colossal failure.&#8221;<\/p>\n<p>In fact, Judge Allen says, at no time in the history of The Bahamas\u2019, has such a &#8220;tremendous&#8221; caseload existed and so much demanded of so few.<\/p>\n<p>While the case load may be extraordinary, her comments do not adequately refute the fact that the Bahamian judiciary is a colossal failure.<\/p>\n<p>&#8220;My considered view is that our judiciary, which has only had a significant complement of Bahamians within the last 15 to 20 years, is a success,&#8221; she said.<\/p>\n<p>The acting chief justice was responding to an editorial which appeared in The Tribune calling the Bahamian judiciary a &#8220;collossal failure&#8221;.<\/p>\n<p>The editor&#8217;s comments were concerned with the collective failure of the entire judicial system, not just the judges and magistrates.<\/p>\n<p>But Justice Allen was out to defend the judges. She was addressing new counsel and attorneys, who were recently called to the Bar.<\/p>\n<p>&#8220;The spiraling of crime in our country has placed a severe strain on the administration of justice with the astronomical increase of serious criminal cases before the courts,&#8221; she said.<\/p>\n<p>Allen fails to accept the judiciary&#8217;s responsibility for the case backlog.\u00a0 If judges would enforce the law, and not continually allow attorney to abuse the system, there would be a much smaller backlog.<\/p>\n<p>Some of the ridiculous defences that Wayne Munroe and Murielle Ducille present to the court would be funny if the cases were not so serious.<\/p>\n<p>And lawyers like Phillip &#8216;Brave&#8217; Davis and Godfrey &#8216;Pro&#8217; Pinder are experts at delaying trials for all sorts of silly reasons which some judges seem to allow.<\/p>\n<p>Mrs. Allen said all judges, including Bahamians, have performed well.<\/p>\n<p>In fact, she said any failures in the system cannot be placed at the feet of the Bahamianisation of the judiciary.<\/p>\n<p>The Progressive Liberal Party (PLP) also recently disagreed with the <a href=\" http:\/\/www.tribune242.com\/hurricane\/09032010_CourtPractices_editorial_pg4\" target=\"_blank\">Tribune editorial<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Senior Supreme Court Justice Anita Allen has fired back at criticisms that the Bahamianisation of the judicial system has been a &#8220;colossal failure.&#8221;<\/p>\n","protected":false},"author":12,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"rop_custom_images_group":[],"rop_custom_messages_group":[],"rop_publish_now":"initial","rop_publish_now_accounts":{"facebook_10223285771444175_51037792744":""},"rop_publish_now_history":[],"rop_publish_now_status":"pending","footnotes":""},"categories":[12],"tags":[93,32,49],"class_list":["post-2534","post","type-post","status-publish","format-standard","hentry","category-headlines","tag-corruption","tag-courts","tag-law"],"_links":{"self":[{"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/posts\/2534","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/users\/12"}],"replies":[{"embeddable":true,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/comments?post=2534"}],"version-history":[{"count":0,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/posts\/2534\/revisions"}],"wp:attachment":[{"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/media?parent=2534"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/categories?post=2534"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/tags?post=2534"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
