{"id":35816,"date":"2013-05-22T09:06:58","date_gmt":"2013-05-22T13:06:58","guid":{"rendered":"http:\/\/www.bahamasb2b.com\/news\/?p=35816"},"modified":"2013-05-22T09:06:58","modified_gmt":"2013-05-22T13:06:58","slug":"judicial-review-over-nygards-breach-of-duty","status":"publish","type":"post","link":"https:\/\/www.bahamasb2b.com\/news\/2013\/05\/judicial-review-over-nygards-breach-of-duty","title":{"rendered":"Judicial Review Over Nygard&#8217;s &#8216;Breach Of Duty&#8217;"},"content":{"rendered":"<p><a href=\"https:\/\/www.bahamasb2b.com\/news\/2013\/05\/judicial-review-over-nygards-breach-of-duty-35816.html\/nygard-peter\" rel=\"attachment wp-att-35817\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-35817\" title=\"nygard-peter\" src=\"https:\/\/www.bahamasb2b.com\/news\/wp-content\/uploads\/2013\/05\/nygard-peter.jpg\" alt=\"\" width=\"500\" height=\"375\" srcset=\"https:\/\/www.bahamasb2b.com\/news\/wp-content\/uploads\/2013\/05\/nygard-peter.jpg 500w, https:\/\/www.bahamasb2b.com\/news\/wp-content\/uploads\/2013\/05\/nygard-peter-150x112.jpg 150w, https:\/\/www.bahamasb2b.com\/news\/wp-content\/uploads\/2013\/05\/nygard-peter-250x187.jpg 250w\" sizes=\"auto, (max-width: 500px) 100vw, 500px\" \/><\/a>The Government\u2019s alleged failure to prevent \u201cunauthorised development activities\u201d at Clifton Bay by Peter Nygard and his attorney, Keod Smith, is to be challenged by Judicial Review.<\/p>\n<p>The Coalition to Protect Clifton Bay, in Supreme Court filings that seek permission to bring the action, warned that \u201cbreach of their statutory duty\u201d by the<\/p>\n<p>Prime Minister and other Cabinet Ministers &#8211; meaning their alleged failure to enforce the rules &#8211; was undermining \u201cthe rule of law\u201d in the Bahamas.<\/p>\n<p>The Judicial Review application, filed on May 17, 2013, focuses on the groyne construction and seabed dredging at Nygard Cay, plus the construction of a new dock and boulder placement at Jaws Beach that was allegedly directed by Mr Smith.<\/p>\n<p>The Coalition is alleging that the activities at both locations are illegal, as they lack the required government permits and approvals.
