{"id":36540,"date":"2013-06-12T08:55:27","date_gmt":"2013-06-12T12:55:27","guid":{"rendered":"http:\/\/www.bahamasb2b.com\/news\/?p=36540"},"modified":"2014-03-11T17:17:36","modified_gmt":"2014-03-11T21:17:36","slug":"judges-should-be-held-accountable","status":"publish","type":"post","link":"https:\/\/www.bahamasb2b.com\/news\/2013\/06\/judges-should-be-held-accountable","title":{"rendered":"Judges Should Be Held Accountable"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-32221\" title=\"gavel-s\" alt=\"\" src=\"https:\/\/www.bahamasb2b.com\/news\/wp-content\/uploads\/2013\/02\/gavel-s.jpg\" width=\"200\" height=\"150\" srcset=\"https:\/\/www.bahamasb2b.com\/news\/wp-content\/uploads\/2013\/02\/gavel-s.jpg 200w, https:\/\/www.bahamasb2b.com\/news\/wp-content\/uploads\/2013\/02\/gavel-s-150x112.jpg 150w\" sizes=\"auto, (max-width: 200px) 100vw, 200px\" \/>Attorney General Allyson Maynard Gibson recommended that judges be held accountable for long delays in \u201crendering judgments.\u201d<\/p>\n<p>Mrs Maynard Gibson made her comments before the Constitutional Commission.<\/p>\n<p>She said it may be time to look into whether some form of \u201cjudicial misconduct\u201d be added to the constitution for judges who take \u201ctoo long\u201d by the standards to produce judgments.<\/p>\n<p>\u201cGiven the current circumstance of the civil backlog, in some cases with judgments being outstanding for more than two years, the time may have come for an evaluation to be made whether such delays in rendering judgments should constitute some form of judicial misconduct for which judges should be held accountable,\u201d she said.<\/p>\n<p>\u201cFor example, in several Latin American countries (Ecuador is an example) at least one country within the Commonwealth Caribbean \u2013 namely Guyana \u2013 have made such provisions. Article 197 (3) of the Guyana Constitution includes among the grounds for the removal of a judge from office, that of \u201cpersistently not writing decisions or for continuously failing to give decision and reasons therefore within such time as may be specified by Parliament.\u201d<\/p>\n<p>Mrs Maynard Gibson also said that judicial training should be mandatory prior to taking judicial office because \u201cjust because someone is a good lawyer does not mean they will automatically be a good judge.\u201d<\/p>\n<p>\u201cThese considerations,\u201d she said, \u201dare important as in today\u2019s world a judge is more than a Judicial officer. Other democracies have recognized that a judge is also an administrator. Judges must be held accountable to objective measurement of the efficient use of judicial time.
