{"id":5686,"date":"2011-01-14T08:54:00","date_gmt":"2011-01-14T13:54:00","guid":{"rendered":"http:\/\/www.bahamasb2b.com\/news\/?p=5686"},"modified":"2015-07-31T18:08:10","modified_gmt":"2015-07-31T22:08:10","slug":"chief-justice-admits-challenges-faced-by-judiciary","status":"publish","type":"post","link":"https:\/\/www.bahamasb2b.com\/news\/2011\/01\/chief-justice-admits-challenges-faced-by-judiciary","title":{"rendered":"Chief Justice Admits &#8216;Challenges&#8217; Faced By Judiciary"},"content":{"rendered":"<p>Chief Justice Sir Michael Barnett promised to place greater focus on the work of the criminal court which has been fraught with problems and incompetence for years.<\/p>\n<p>The Chief Justice said he will even hear some bail application matters himself in order for Supreme Court justices to have more time to preside over criminal cases.<\/p>\n<p>&#8220;It is our intention to dedicate four courts in New Providence and one in Grand Bahama to deal exclusively with criminal matters,&#8221; Barnett said.<\/p>\n<p>Mr Barnett has asked Senior Justice Jon Isaacs to assume a greater role in the administration of the criminal division of the Supreme Court.<\/p>\n<p>Isaacs has a reputation for inexplicably granting bail to serious criminals.<\/p>\n<p>Additionally, Justice Bernard Turner, who now has oversight of civil cases, will begin to hear criminal matters, Barnett announced.<\/p>\n<p>Turner has been criticised for his level of incompetence when he was Director of Public Prosecutions.\u00a0 Many feel that it was Turner&#8217;s incompetence that caused many of the challenges that the legal profession now faces.<\/p>\n<p>Meanwhile, Barnett said several senior lawyers will be appointed as acting judges on the civil side. Those newly minted judges will hear civil matters currently scheduled to be heard by Turner.<\/p>\n<p>Seeing as the vast majority of criminal matters are handled in the magistrate\u2019s courts, Barnett called on magistrates to be more aggressive in the management of their cases.<\/p>\n<p>He admitted that summary matters should be dealt with quickly and adjournments and delays must be kept to a minimum.<\/p>\n<p>Barnett admitted failure on the part of the judiciary while promising to address the massive backlog of cases.<\/p>\n<p>&#8220;We are not unaware of our own failures and the need to reduce delay in the delivery of our rulings,&#8221; he said.<\/p>\n<p>In an effort to squelch criticism of the judiciary and to intimidate critics, he issued a veiled threat, saying, &#8220;we read with some degree of concern comments made by members of the pubic about the work of the judiciary.&#8221;<\/p>\n<p>Several Bahamian judges have threatened the media in the past, thinking they are immune from criticism and saying that critics will be held in contempt of court.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Chief Justice Sir Michael Barnett promised to place greater focus on the work of the criminal court which has been fraught with problems and incompetence for years.<\/p>\n","protected":false},"author":8,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"rop_custom_images_group":[],"rop_custom_messages_group":[],"rop_publish_now":"initial","rop_publish_now_accounts":{"facebook_10223285771444175_51037792744":""},"rop_publish_now_history":[],"rop_publish_now_status":"pending","footnotes":""},"categories":[12],"tags":[93,32,49],"class_list":["post-5686","post","type-post","status-publish","format-standard","hentry","category-headlines","tag-corruption","tag-courts","tag-law"],"_links":{"self":[{"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/posts\/5686","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/users\/8"}],"replies":[{"embeddable":true,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/comments?post=5686"}],"version-history":[{"count":0,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/posts\/5686\/revisions"}],"wp:attachment":[{"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/media?parent=5686"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/categories?post=5686"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.bahamasb2b.com\/news\/wp-json\/wp\/v2\/tags?post=5686"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
