The Supreme Court has given the Save Guana Cay Association (SGCA) leave to seek a judicial review in a move against the Bahama government.
Justice Stephen Isaacs yesterday granted the association’s application for a review, in which Prime Minister Perry Christie, as minister responsible for Crown Lands, and Wendell Major, as Secretary to the National Economic Council, are named as respondents.
Following weeks of controversy surrounding the $500 millin Baker’s Bay development in Guana Cay, which residents claim will have destructive and irreversible effects on the environment of the small island, the SGCA on Monday filed an application to challenge the government as a whole to question its authority to sign a heads of agreement.
The application further called for a Supreme Court declaration that the heads of agreement was entered into in breach of the law, as well as an order that prohibits the prime minister and Mr. Major from granting leases of any part of the Crown Land or Treasury Land.
