Murder Acquittal Overturned, New Trial Ordered

The Court of Appeal on Monday overturned the acquittal of a man who faced a murder charge for allegedly running over a man with his car.

Tyrone Francis, who is on bail, will now face another trial for the murder of Jonathan Linden.

Prosecutors alleged that Francis used his vehicle as a deadly weapon when he knocked down Linden on October 9, 2009, shortly after they had an argument at Royal Castle on Baillou Hill Road.

Last year, Justice Vera Watkins directed the jury to acquit Francis when she ruled that the prosecution had failed to produce evidence to support the charge.

The judge directed the acquittal 11 days after the Court of Appeal Amendment Act became law on November 4, 2011.

The amendment gives prosecutors the right to challenge a judge’s decision to uphold a no case submission or withdraw a case from the jury at the close of the prosecution’s case.
